This Participation Agreement (“Agreement”), governs the terms and conditions for participation by a Client identified below (“Client”) in the Soul Energy Alignment Beta Program (Group or 1:1) (“Programme”) created by Sarah McKenna (trading as “Sarah McKenna”) and I am contactable via email at sarah@sarahmckenna.uk (“Coach” or “Consultant” or “me” or “I”).

Background

I trade as Sarah McKenna and I am a mentor and provider of coaching, training and consultancy services for small business owners. I run retreats, virtual retreats, 1:1 and group programmes, and self-study courses as part of my offerings. You joined one of my beta mentoring programmes (group or 1:1).

We have therefore agreed to enter into this Agreement together. I will now set out what the Program will deliver to you, how you will interact and learn during this Program, and grant you rights to access and use certain of my bespoke methodologies and materials on the terms and conditions set out in this Agreement.

Program Fee and Payment Schedule

The full price of this beta program is £600 (group version) or £1,111 (1:1 version), and this is payable in full at time of purchase. If you choose to pay in instalments, you are agreeing to pay the following:

Group version of program = £150 at time of purchase, followed by three additional payments of £150, at monthly intervals after initial payment.

1:1 version of program = £277.75 at time of purchase, followed by three additional payments of £277.75, at monthly intervals after initial payment,

**Early Bird pricing is only available on pay in full payments made before the 21st of February2024 and is priced at £480 for the group version, and £888 for the bespoke 1:1 version of this program.**

The Beta Program fee includes:

9 x 60 min sessions (Group Version), running over 15 weeks, as detailed on the sales page.

9 x 75 min sessions (1:1 Version), running over 15 weeks.

Both versions includes healing Conscious Energy Clearing® Codes during the program, and a 15 chakra advanced full body cleanse, as detailed on the sales page.

The Beta Program - Details:

The beta program will begin with an Opening Ceremony on the 6th of March2024.

Weekly sessions will then be held on Zoom, every Wednesday at 7.30pm GMT - this will be 9 sessions, spread over 15 weeks, so there will be a week's break aproximately every 4th week. Details of all dates will be sent out in calendar format, once the beta program is live.

The closing ceremony & chakra cleanse will be held on the 29th of May 2024.

Access to a Facebook group will be provided.

It is the client’s responsibility to attend these Zoom Sessions and to also implement any learning from the Beta Programme. A replay of all calls (except the Conscious Energy Clearing® Code sessions) will be available inside of the Facebook group.

Please note: Calls for the 1:1 Beta Program WILL NOT be recorded, unless you specifically request this at the beginning of the call. Call cancellations for the 1:1 calls can be rescheduled by email or telephone, no less than 24 hours prior to the start of the call.

IMPORTANT NOTICE - BETA PROGRAM (GROUP & 1:1 VERSIONS)

As this is a Beta program, it has been priced accordingly. You appreciate that as this is a beta program, it is still being refined and written, and may have minor delays or errors. By signing up at the Beta program price, you are agreeing to help finetune this program and provide an honest testimonial at the end of the 15 weeks. This testimonial will then be used to advertise and promote the program at the higher price, at a later date, both on the sales page and on social media. By purchasing this Program you are agreeing to these terms.

Cancellations & Refunds

I adhere to the statutory 14 Day Refund Policy for Digital Products. However, once any of the Program calls have been attended, the Participant waives the right to this refund policy immediately and no refunds can be given.

Requests for cancellations and/or refunds received by “me” outside of this will not be honoured and any outstanding balance owed to ‘me’ for the Programme must be paid in full.

Your Participation In This Service

You agree that full participation in the Service is necessary in order to achieve the best possible results and outcomes from your personal perspective. 

You accept and agree that you are one hundred percent 100%) responsible for your own actions, including your participation, progress, and results during the Terms of the Service. 

You agree that you are responsible for your own personal wellbeing and that the Service is not to be used in lieu of professional advice for legal, financial, medical, tax or other matters normally handled by professionals.

I will do my best to support you with getting the maximum benefit from the provision of the Service, but I cannot guarantee that the Service will meet your specific expectations or that you will achieve any particular outcomes or results, financial or otherwise. 

Confidentiality

I agree not to (except in the proper course of my duties) use or disclose to any third party any Confidential Information. This restriction does not apply to:

a) any use or disclosure authorised by you or required by law; 

b) any use or disclosure which I in my absolute discretion, consider necessary or advisable in order to prevent illegal acts or harm to you or to others; or

c) any information which is already in, or comes into, the public domain otherwise than through my unauthorised disclosure.

Data Protection and Intellectual Property

You acknowledge and agree that your personal data will be processed by and on behalf of me as part of me providing you with the Services.

All Intellectual Property Rights and all other rights in the materials and content that I use within the Sessions are owned by me alone. 

Participants will not use, copy, publish, reproduce, share or allow anyone else to use or reproduce such content or materials in any way, without prior written permission from me.

I grant to you a limited, non-exclusive, non-transferable, non-sub licensable revocable licence to use all or any of the content or material used in the Sessions for the purposes for which the Sessions were provided only.

You may not, without my prior written consent, make any audio or visual recordings of all or any part of our Sessions. 

Warranties

The Service and access to any of its content is made available without warranty of any kind. I have taken all reasonable steps to ensure that it is of satisfactory quality and reasonably fit for the purpose for which it was advertised and on the basis of which you purchased. 

To that end, I give no specific guarantee or reassurance as to the results of participating in the Service and/or using the content. You accept and agree that your entry into any program does not guarantee you any specific results in your personal or professional life, career, or business growth. The results and benefits received by participants in the Program can and do vary.

Any testimonials provided on my website or otherwise do not and are not intended to represent or guarantee that any other participant in our Services will receive the same results or benefits.

Governing Law and Jurisdiction

This agreement shall be governed by English law. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter.

Entire Agreement

This agreement sets out the entire agreement between us in relation to your rights as a recipient of the Service. This agreement supersedes any and all prior agreements, communications, and proposals. You agree that in entering into this Agreement you have not relied on any statement or representation made by any person (including third party) relating to membership of the Programme or provision of the Service.
